Kovi Terms and Conditions

Welcome to Kovi. These Terms and Conditions ("Terms") govern your use of the Kovi mobile application ("App"), operated by Kovi ("we", "us", or "our").

By accessing or using Kovi, you agree to these Terms. If you do not agree, do not use the App.

1. About Kovi

Kovi is a digital life coaching app designed to help users set goals, build habits, reflect through journalling, and receive AI-powered coaching support.

Kovi provides guidance, structure, and encouragement, but it does not provide medical, psychological, or professional advice.

2. Eligibility

You must:

  • Be at least 18 years old
  • Have the legal capacity to enter into a binding agreement

By using Kovi, you confirm that you meet these requirements.

3. Account Registration (Required)

To use Kovi, you must create an account.

You agree to:

  • Provide accurate and up-to-date information
  • Keep your login details secure
  • Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

4.1 Subscription Model

Kovi may offer free trials and monthly or annual subscriptions.

4.2 Billing

  • Payments are processed through your app store provider, such as Apple App Store or Google Play
  • Subscriptions renew automatically unless cancelled

4.3 Cancellation

  • You can cancel your subscription via your app store account
  • Cancellation takes effect at the end of the current billing period
  • No refunds are provided for unused time unless required by law

5. Acceptable Use

You agree not to:

  • Use Kovi for unlawful purposes
  • Attempt to reverse engineer or disrupt the App
  • Upload harmful, abusive, or offensive content
  • Misuse the coaching system, including attempts to manipulate or exploit it

We may suspend or terminate access if these rules are violated.

6. Coaching and AI Disclaimer

Kovi provides AI-generated coaching and guidance.

You acknowledge that:

  • Kovi is not a licensed therapist, medical professional, or financial advisor
  • Advice provided is general guidance only
  • You should seek qualified professionals for serious or sensitive issues

Kovi is intended for personal development and wellbeing support, not crisis or emergency use.

7. No Guarantees of Results

Kovi is designed to support personal growth, but we do not guarantee any specific results or outcomes.

You acknowledge that:

  • Progress depends on many factors outside our control, including personal circumstances and consistency
  • Examples and guidance are illustrative only and not promises of success
  • Outcomes such as improved habits, goal achievement, or life changes are not guaranteed

You are solely responsible for how you use the App and any decisions or actions you take.

8. User Content

You retain ownership of the content you create, such as goals and journal entries.

By using Kovi, you grant us a licence to:

  • Store and process your content
  • Use anonymised data to improve the App

We do not sell your personal content.

9. Data and Privacy

Your use of Kovi is also governed by our Privacy Policy.

We:

  • Store and process your data to provide the service
  • Use analytics to improve the App
  • Take reasonable steps to protect your data

10. Intellectual Property

All rights in the App, including design, features, branding, and AI systems, are owned by Kovi or its licensors.

You may not copy, modify, distribute, or reuse any part of the App without permission.

11. Service Availability

  • We do not guarantee uninterrupted access
  • Features may change, improve, or be removed at any time

12. Limitation of Liability

Nothing in these Terms excludes or limits liability where unlawful to do so, including death or personal injury caused by negligence, or fraud or fraudulent misrepresentation.

To the fullest extent permitted by law, Kovi is not liable for:

  • Decisions you make based on coaching or guidance
  • Loss of data, although we take reasonable precautions
  • Indirect, incidental, or consequential damages, including loss of profits or opportunity

Liability Cap

Our total liability for claims related to your use of Kovi is limited to the total amount you paid for the App in the 12 months before the event giving rise to the claim.

If you have not paid for the App, liability is limited to GBP 50.

13. Termination

We may suspend or terminate your access if you breach these Terms or harm the App or other users.

You may stop using Kovi at any time.

14. App Store Terms (Apple and Google)

14.1 Apple App Store

  • These Terms are between you and Kovi, not Apple
  • Apple is not responsible for the App or its content
  • Apple has no obligation to provide maintenance or support
  • In case of warranty failure, you may notify Apple and Apple may refund purchase price if applicable
  • Apple is not responsible for claims relating to the App, including product liability, legal compliance, or intellectual property claims
  • You must comply with Apple's App Store Terms of Service

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

14.2 Google Play Store

  • These Terms are between you and Kovi, not Google
  • Google is not responsible for the App or its content
  • Your use must comply with Google Play's Terms of Service
  • Google has no obligation to provide support or maintenance

15. Changes to These Terms

We may update these Terms from time to time. Changes take effect once published. Continued use of Kovi means you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of England and Wales.
